Enforcement

From the enforceable instrument to actually receiving the money: preparing the request, following the procedure, answering enforcement disputes.

Many people reach the judgment and stop there. A judgment is a document; getting the money to the person entitled to it is a separate stage with its own procedure and its own paperwork.

The service starts by examining the instrument the client holds: is it of a kind that can be enforced, do its details match, and is the amount specified and enforceable as it stands? A great many requests are returned because of that point alone.

The request is then filed and followed up, any dispute raised by the debtor is answered, and the measures available under the law are considered according to the state of the file.

What this service covers

  • Examining the enforceable instrument and checking its details before filing
  • Drafting the request for a specified amount, enforceable as it stands
  • Filing the enforcement request and following its procedure
  • Answering an enforcement dispute and the debtor’s defences
  • Pursuing the measures available under the law as the file requires
  • Exploring rescheduling or settlement within the enforcement file

Where the work stops

  • Collection cannot be guaranteed if the debtor has nothing to enforce against
  • No step is taken outside what the competent authority permits
  • No estimate is given for how long an enforcement file will take

What to prepare before we start

  1. The original enforceable instrument or an official copy

  3. The debtor’s details exactly as they appear in the instrument
  4. A record of anything already paid
  5. Any agreement the parties reached after the instrument was issued

How a request is reviewed

  1. First contact
  2. Scope and conflict check
  3. Agreement on service and fees
  4. Work begins
